The director of the Department for the Prosecution of Corruption (DPCA) Hotoniel Bonilla Garcia has criticized the lack of transparency of government officials and the fact that the penal justice system is only for the weak in the DR. Bonilla Garcia said he is concerned about the fact that the justice system has been incapable of penalizing government officials for corruption. He expressed his concern that 2009 was a year when impunity was stimulated by the benevolence of the judges. He said that "the justice system needs to play a more decisive role in addressing the illicit enrichment of government officials," as reported in Hoy.
Furthermore, Diario Libre quotes Bonilla as saying: "When there is no penalty, the prosecutors themselves, in many cases, lose heart, because they present cases with all the evidence, all the proof and the people are discharged," he said.
Bonilla said that in the court "some loophole is found in every case, with the exception when those involved are people with minimum influence." He expressed hope that government officials would be more transparent in 2010.
In 2009, the CPA concluded 52 cases, of which 43 are under investigation, 4 arrest orders were recommended and 7 were sent to court, according to the Prosecutor General's Office 2009 Report. The cases where arrest orders were placed affect the mayor of Villa Altagracia and the director of the southwestern division of the Ministry of Agriculture based in San Juan de la Maguana.
