Although the original decision was controversial, the decision not to free Colonel Pablo Leonel Velaquez Taveras, accused of being the mastermind behind the murder of Major Jose Miguel Herran Mancebo, after he was discharged by the Court of Appeals of San Cristobal, was considered to be a "retrograde step" for the Dominican justice system by legal experts consulted on the case.
The president of the Justice and Transparency Foundation, Trajano Potentini, condemned "any act of disobedience to the Law" describing it as an "outrage because it is ignoring the legality of a judge who has the faculty to dictate and resolve", he said. Potentini pointed out that this should be separate from private concerns and to assess guilt or innocence of the problems belonging to "the mastermind which is something not contemplated in the current code".
Jesus Fernandez Velez, prosecutor of the Court of Appeals of San Cristobal, told Diario Libre that Velasquez Taveras was still in Najayo Prison. He said that he had entered an appeal on the court's decision. Candido Simon Polanco, the lawyer for Herran Mancebo's family, stated yesterday that he would appeal the decision of the tribunal shortly.
