Mistakes attributed to the running of the Justice Department itself have caused literally thousands of cases to be thrown out of the courts during the investigative phase. According to Diario Libre, this is why so many courts have to dictate sentences of cessation due to time running out without a formal accusation being formulated. According to the new Penal Code Process Law (Codigo Procesal Penal), District Attorneys are responsible for presenting the formal indictments to the magistrates. Other causes are related to the contamination of the crime scene, or the evidence or the time period given by the magistrate to produce the indictments. Prosecutors are responsible for presenting the accusations before the judge and requesting which of seven different coercive measures are to be used in the case. The measures are spelled out in the Penal Code. They include bail, travel restrictions, supervision, periodic appearances before a magistrate, electronic ankle tags (so far not in use), house arrest and preventive custody or remand without bail. The most common cause of a case failing to be resolved is when the DA fails to finish the investigation and present the case before the magistrate in a timely fashion.
