Responding to the public outcry in response to a spate of lenient decisions by judges, the president of the Supreme Court of Justice Jorge Subero Isa said that the Supreme Court judges had met and issued a resolution urging judges to be more drastic in their decisions against people accused of crimes. They called on judges to review the cases jointly and harmoniously, taking into account the elements and circumstances before allowing anyone accused of homicide, drug trafficking, kidnapping and other serious crimes to go out on bail or other measures that releases them from preventive jail while their case is being heard.
Upon announcing Resolution 58-2010, Subero Isa said that for the first time, society was demanding that judges should be more drastic when issuing their decisions against people suspected of crimes, as reported in Listin Diario.
The resolution establishes that any judge or court reviewing a preventive custody measure needed to justify the decision before changing it.
The resolution comes on the heels of the revocation of preventive jail sentences issued in several drug trafficking and money laundering cases.
Subero Isa said that judges Rene del Rosario and Jose Alejandro Vargas are under investigation after their decisions to release murder suspects.
The judges used loopholes or articles in the Penal Code that allowed for these suspects to be legally released.
