Judge Pedro Reynaldo Vasquez Lora of the Second Chamber of the Civil and Commercial Court has ordered the Central Electoral Board (JCE) to register the candidacy of former Police chief Bernardo Santana Paez. Santana wants to run for deputy in El Seibo, in an alliance between the ruling PLD party and the PRSC.
Guarino Cruz, legal advisor to the JCE, said the judgment does not have legal grounds. He said the JCE would appeal and the Supreme Court of Justice would have the last word. Cruz said that the judgment would not apply because Santana was replaced by Soraya Maria Chahin, who was already registered.
The JCE rejected Santana's candidacy because the deadline for registering candidates had expired on his retirement date, 2 March 2010.
Santana said he took the case to court seeking his rights. He argued that he was a member of the police, not a military official. The judgment orders the JCE to register Santana's candidacy within three days, or the court will impose a penalty to be paid per day of delay in fulfilling the court order.
