This week the Supreme Court of Justice dismissed substitute judge Raul Rosario Hernandez for ordering the release on bail of Raul Serumberto Reynoso Mota (Vantroi) on 26 April. Vantroi is accused of 36 murders.
Interestingly, El Nacional reported that judge Rosario Hernandez had less than a month left on his contract. He had been hired on 21 April to serve until 14 May by Administrative Order 025-2010 issued on 6 April by the Presidency of the Civil Chamber of the Court of Appeals of the Province of Santo Domingo. He had been appointed to replace judge Milagros Mercedes Ramirez who had been called to act as substitute at the Civil and Commercial Chamber Court of First Instance in Monte Plata.
According to El Nacional, a subsequent order 031-210 from the same court in the province of Santo Domingo canceled the appointment.
El Nacional reports that Rosario Hernandez was a lawyer who had been contracted to act as substitute judge at the Court of Peace of Yamasa.
El Nacional says that the reason why the substitute judge was chosen to hear Reynoso Mota's release request is unknown. The Supreme Court of Justice gives no explanations for this irregularity.
Supreme Court judge Rafael Luciano Pichardo, speaking for the Supreme Court, said that Rosario Hernandez was a lawyer and not an employee of the judicial branch.
Speaking on the El Gobierno de la Manana morning talk show, judge Rosario defended himself saying that the case was poorly put together. He said he did not know who Vantroi was before handling the case, and acted on what he read in the case. He said he did not sit in for any judge. He explained that at that court several temporary judges are rotated.
