Three Dominicans have been charged with conspiracy to conceal illegal aliens from detection in a federal court in Boston, Massachusetts. US Attorney Carmen M. Ortiz and Bruce M. Foucart, Special Agent in Charge of US Immigration and Customs Enforcement, Office of Investigations in Boston, announced on Wednesday, 8 July that Jose Elias Zaiter Pou, 61, and Ricky Dario Baez Cruz, 29, both from the Dominican Republic, and Luz Martinez Lebron, 41, of Lynn, were charged in a criminal complaint with a conspiracy to conceal and shield illegal aliens from detection.
El Dia reports that Zaiter is a medical colonel in the Dominican army. It reports that deportees who had cases pending with US Justice were operated on in an apartment in Bani. The procedure involved replacing special material on their fingertips to change their fingerprints when going through US Migration. As reported, the Feds are on the trail on the network that involved other civilian and military doctors in both ambulatory visits and in medical centers in the DR.
El Dia reports that Zaiter worked as a surgeon at the Hospital Nuestra Senora de Regia and saw patients at the Social Security Institute, both in Bani. He served as provincial medical director in the eastern region from 2000-2004, based in San Pedro de Macoris.
The US Justice Department complaint alleges that the defendants were involved in a conspiracy to help illegal aliens evade detection through the mutilation or surgical removal of their fingerprints. It is alleged that Martinez Lebron arranged for patients to undergo the procedures performed by Zaiter Pou, a doctor with a clinic in the Santo Domingo. Zaiter Pou traveled to the US to operate for US$4,500. It is alleged that Martinez Lebron's ex-husband, Baez Cruz, also had the procedure performed by Zaiter.
A detention hearing is set for Tuesday, 13 July at 2pm.
If convicted on these charges, Zaiter, Baez and Martinez each face up to 10 years imprisonment, to be followed by three years of supervised release and a US$250,000 fine.
The case, which was investigated by US Immigration and Customs Enforcement, is being prosecuted by Special Assistant US Attorney Jerry DeMaio of Ortiz's Major Crimes Unit.
