Acontecer Judicial, a website that covers legal matters in the DR, reports that Felix Humberto Porte Nunez, legal defense for Sobeida Felix Morel, was deported from the US on 11 June 1999 for possession of equipment used for the smuggling of drugs. He is also acting as lawyer for Jose David Figueroa Agosto.
In 1999 Portes was sentenced to 4 years in jail for violating the Penal Code 2C-2.35 10A-1. He had been arrested on 27 March 1989 and was declared guilty of possession of drugs on 19 March 1990. At the time, he was 19 years old.
On 8 July 1991, he was arrested for double possession of cocaine, and on 1 May 1992 was found guilty of manufacturing, distributing cocaine, and sentenced to 15 years in prison for violation of Penal Code 2C-2.35 5A 1b1. He served half of the sentence.
Sobeida Felix Morel was arrested on 4 September 2009 at the Torre Alco Paradisso in La Esperilla. She was sent to Najayo Jail as her case was investigated, but would be released on bail. She skipped bail in October and was declared fugitive of justice. Nevertheless, she was able to travel to Puerto Rico where she met with her boyfriend Jose David Figueroa Agosto.
Judge Claribel Nivar Arias set the case against of her for hearings beginning on 11 August. Other dates are 13, 20, 27, 30 August.
Felix Morel maintains her innocence. "I feel confident that all will end well because I have nothing to do with this process," she said.
Also present during the hearing on Friday were Mary Pelaez and her sister Adolfina Pelaez, Sammy Dauhajre, Eddy Brito, Ricardo Ivanovich Smester, Juan Jose Fernandez Ibarra, under arrest also for complicity with drug trafficking and money laundering. Also present was Madeline Bernard, wife of murdered Police Colonel Jose Amado Gonzalez Gonzalez.
Lawyer Juan Miguel Castillo Pantaleon says Sobeida Felix might be right in feeling confident in a positive end to her case. As reported in the Listin Diario, he says: "The prosecutor general's greatest task will be in finding concrete ties and establishing, beyond all reasonable doubts, with proofs, that these persons are responsible, because the group of persons in this complex case are heterogenous," he explained.
