After accepting a request from the Santiago District Attorney, the judge for the Court of Instruction, Agueda Garcia, has ordered eight months preventive custody for the three defendants in the multi-million peso fraud case at the local Customs office. At the same time, she declared the case to be complex. While the defendants, Miguel Angel Lazala, Gerald Estevez Lazala and Adalberto Rosa Rosario were led to the holding cells in the Palace of Justice, deputy-elect Adalberto Rosa, the father of one of the accused was seen leaving the court with his head down.
Meanwhile, District Attorney Yenny Berenice Reynoso said that the judge accepted the prosecutors' request since they presented more than 80 pieces of evidence against the accused. "It was a decision taken based on the law, the judge weighed the orderliness and strength of the evidence", she said. Adalberto Rosa's lawyer, Victor Nunez, said that they would appeal the judge's decision on the understanding that this was the result of media pressure and institution fears, combined with the pressure from the District Attorney. The Judicial process resumed at 10:30 yesterday morning with a hearing of the challenge by the lawyers for the accused against the judge for Permanent Attention for the judicial district of Santiago, Thelma Virginia Reyes, who had substituted Agueda Garcia, who had removed herself on Wednesday morning until yesterday when the court decided that she should resume her responsibilities towards the case. After a three-hour recess, at 10:00 o'clock last night, Judge Agueda Garcia issued her decision.
