A man has been convicted by the Second Collegiate Tribunal of the National District and sentenced to serve an eight-year sentence and pay damages to the Central Electoral Board (JCE) for the actual damages that were caused by having two cedulas, ID cards, obtained with forged documentation. Maximo Suero Feliz obtained a second cedula with the name of Odalis Elias Tejada Hernandez and a third one, in the name of Rafael Bonifacio Contreras.
The JCE's Litigation Unit submitted a complaint and an accusation against Suero Feliz for violation of Article 148 of the Dominican Penal Code for using false documents and for violating Articles 7 and 13 of Law 8-92, which covers the cedula and its use. Violations of these laws carry a sentence of 3 to 10 years.
As reported, the fraud was committed so that Suero Feliz could transfer ownership of a property belonging to the real Odalis Elias Tejada Hernandez, worth RD$50 million, and which he used as a guarantee to secure several bank loans, make bank transfers, and sign several types of contracts with the documents procured with the stolen identity. For this crime, convicted for violation of Article 405 of the Dominican Penal Code, he will have to pay RD$5 million in damages to the man whose identity he stole, Odalis Elias Tejada Hernandez.
This will be the first known case of identity theft with a definitive sentence that has been successfully prosecuted by the JCE.
