Betting shop representatives are challenging their closure by the Department of Taxes (DGII) for violation of General Rule 07-2010. The DGII announced the closure of 8,000 shops on Monday.
"We are not evading, because the nature of the law is clear. We are subject to just one tax... The DGII's intention is to collect several billion pesos a year as a result of the same situation that the state is in, looking for new funds", said Ricardo Nadal, the president of the National Association of Sports Betting Parlors (Bancas).
The National Federation of Lottery Betting Parlors (Fenabanca) that represents betting shops say they have filed an appeal against the General Rule of the DGII issued on 28 September that impedes any action that the agency might want to execute until the court rules on the case. Nadal stressed the fact that Law 140-02 establishes a once-a-year tax on the so-called "bancas", that goes from RD$150,000 to RD$220,000, and that "a resolution cannot be above a law". The DGII expects to collect RD$80 million from the tax on prizes.
