The Coalition for Dignified Education said that the judgment that rejects the legal recourse that called for the government to comply with the General Law of Education 66-97 that requires a minimum allocation of 4% of the GDP for education, violates the rule of law in the country. The Coalition says that in its decision the Higher Administrative Court gave in to political pressures from the president of the Senate, Reynaldo Pared Perez (PLD-National District), as reported in 7dias.com.do
In a press release, the group says that the decision threatens the right to education, creating uncertainty and making justice an accomplice of the illegality that is practiced by the government.
The Coalition substantiated their claim on Article 63, Numeral 10 of the Constitution that establishes that the government investment in education should be increasing and sustained.
"The Higher Administrative Court has violated the constitutional order and the guarantee of human rights and created an environment of judicial insecurity and violation of fundamental rights, violating articles 5 and 6 of the Constitution that establishes among other matters that 'All persons and bodies that exercise government are subject to the Constitution, base of state laws'".
The Coalition says they will also take the case to the Inter-American Court of Human Rights for illegalities and illegitimacy in approving the budget in an arbitrary manner.
