Former president of the Dominican Public School Teachers Association, Maria Teresa Cabrera has described the rejection by the First Tax and Administrative Disputes Court of the National District, a higher administrative court, of a recourse against government violation of the 4% for education budget allocation, as an "outrage". She says this sets a precedent and the same could be applied it to other laws.

"In essence, what the sentence says is that all the laws that exist before the present Constitution can be violated and nothing will happen, because the 2010 Constitution does not include a mention for them. The judges ruled that Law 66-97 does not have constitutional ranking and Congress can approve the 2011 budget without the restrictions established in Article 197 of the Constitution because the article mentions a law that would be passed in the future, and Law 66-97 dates back to 1997.

The recourse was presented by the Coalition for Dignified Education. Lawyer Luis Miguel Rivas, of the 'Toy Jarto' movement, one of the members of the coalition, said the measure would be appealed to the Supreme Court of Justice.
