The Senate ruled that the newly created Constitutional Court is not authorized to review decisions reached by the Supreme Court of Justice on constitutional matters. The Senate changed the original version of the Constitutional Court, complying with the opinion of the president of the Supreme Court of Justice Jorge Subero Isa who warned "a clash of trains" would occur. The senators eliminated item 3 of Article 30 of the bill that stipulated the Constitutional Court had to validate the decisions of the Supreme Court of Justice on constitutional matters.

The change was intended to reduce any clash between the two judicial bodies. But Hoy reports, nevertheless, that in article one of the bill, it is established that the Constitutional Court is the "supreme body for the interpretation and monitoring of constitutional matters."

The new organization would be made up by 13 judges to be appointed by the National Council of the Magistracy.
