The 2010 Constitution had set a 26 January deadline for the start of the Constitutional Court, but this will not happen. The court was created to check the constitutional aspects of laws and government actions.

The executive vice president of the Foundation for Institutionalism and Justice, Servio Tulio Castanos Guzman said that there is no time left for the government to meet the deadline established in the 2010 Constitution for the creation of the Constitutional Court that should have been formed by 26 January. The Presidency created a commission to study the bill.

President Leonel Fernandez heads the National Council of the Magistracy that is in charge of choosing the 13 judges of the Constitutional Court. Fernandez will be abroad on a 13-day tour starting Monday, 24 January.

The Constitution establishes that the National Council of the Magistracy will appoint the judges that will replace Supreme Court Judges that are retiring because of age, and those of the Higher Electoral Court.

El Caribe also mentions a new element in the creation of the Constitutional Court. Legal experts say that the National Council of the Magistracy needs to be modified because the new Constitution orders it to have eight members, including the prosecutor general, and not the present seven. Law 169-97 that created the CNM limited its role to appointing the judges of the Supreme Court and now it needs to appoint the members of other courts.
