The president of the Chamber of Deputies, Abel Martinez (PLD) says that the judges of the new Constitutional Court can be chosen, even if the bill that creates the new body has not been approved in Congress. He said that with the approval of the Law that modifies the National Council of the Magistracy, the body that is in charge of choosing the judges of the Supreme Court of Justice and the Constitutional Court, they could be chosen. The bill that creates the Constitutional Court was left for the next legislature, which opens on 27 February. There is an impasse between legislators who favor allowing judges over the age of 75 to be members of the new court, and others who believe that if they are not allowed to be members of the Supreme Court of Justice they should not be eligible for the new Constitutional Court either.

As reported in Listin Diario, Javier Cabreja, executive director of Participacion Ciudadana, a civil society watchdog group, said yesterday that members could not be elected without Congressional approval of the bill. Cabreja said that the Constitution had ordered the bill to be approved by 26 January, so the government is already in violation of the Constitution.
