Orioles pitcher Alfredo Simon will remain in jail after his appeal for bail was rejected by a judge yesterday. Simon is the leading suspect in the shooting of Michel Esteban Castillo Almonte. He is charged with involuntary manslaughter after a celebratory shot he fired into the air on 31 December killed Castillo and injured the deceased's brother, 17-year old Starling Castillo. Simon's lawyers had been hoping that a negative ballistics report and another emerging suspect they presented would help his case. There was also talk of a deal being struck with the family.
Hoy reports that Puerto Plata judge Yakaira Veras, in charge of preparing the case, ordered Simon to spend a year in preventive custody while the case is being heard. She accepted a petition from Puerto Plata prosecutor Carlos Hernandez Castro.
Defense lawyer Dinora Dilone said they would appeal the decision. She argues that the reasons for the preventive custody no longer prevail. She explained that the relatives of the victim and his brother, who was also injured in the shootout, have withdrawn their accusation. Meanwhile, MLB announced that Simon was placed on the restricted list by the Orioles. He had 17 saves last season.
