President Leonel Fernandez returned several bills to Congress on Friday. They are the bill that modifies the National Magistracy Council (the body in charge of choosing the Supreme Court of Justice and Constitutional Court judges), and the bill on the vote of Dominicans living abroad. As reported in Diario Libre, President Fernandez flagged article five that deals with the absences of the President and Vice President and who would replace them.
He also flagged Art. 13 that deals with quorum and adoption of decisions of the CNM. Fernandez proposes that the CNM's decisions should always prevail with the favorable vote by a simple majority of the members present at the meeting. In case of a tie, the CNM president should cast the deciding vote.
The Congress had approved a special majority and left out the president's vote as a mechanism for dealing with a tie. Listin Diario writes that the problem is that in the new Constitution the prosecutor general of the republic was added, including from seven to eight the number of members of the CNM opening the possibility of a tie.

Congress had approved that when the President of the Republic is abroad, he would be replaced by the vice president or one of the members elected by the majority in the Council of Magistracy. Now the President suggests that the prosecutor general, who is appointed by the President, should preside CNM meetings in the absence of the President and Vice President. He suggests the elimination of art 22 that establishes that the CNM will appoint the Constitutional Court judges because this disposition is already included in the article that deals with the functions of the Council.
