The ruling PLD party has backed down from its position and accepted the proposal by the opposition PRD that allowed the Chamber of Deputies to pass the Organic Law of the Constitutional Court in an urgent vote, establishing the obligatory retirement of the judges at 75, same as for the Supreme Court of Justice. The initiative was passed in a first reading with the favorable vote of 148 deputies present at the session and which complied with the special two-thirds majority required by the Constitution for the sanctioning of Organic Laws.
Diario Libre said that the second reading was passed with 107 votes since some of the legislators had left after the first discussion. With this approval, the stalemate that kept the legislation from being passed during the special legislative session that ended on 17 February has been overcome. According to Article 52, the Constitutional Court will have the authority to review judicial decisions that have acquired their final decision after 26 January 2010, when the new Constitution was proclaimed and went into force.
