President Leonel Fernandez has issued Decree 143-11 that declares the need to increase low cost electricity generation capacity as a national urgency. The system is operating with a permanent deficit in production. The decree establishes that this increase in the low cost electricity capacity is aimed at preventing shortages, facilitating the optimization of the kind of fuel, allowing for the necessary investments for the recovery of losses in distribution companies, recovering the balance in the national electricity system, and preventing an imminent generation crisis that would undermine security and the public interest.
Citing Law 340-06 on Government Procurement, President Fernandez ordered the Public Electricity Corporation (CDEEE) and its executive vice president to introduce and coordinate procurement guidelines. Exceptions to the procurement guidelines of Law 340-06 is granted to the distribution companies EdeEste, EdeSur, EdeNorte and CDEEE, all government entities that are subject to procurement laws of the CDEEE.
