An agreement signed yesterday by the President of the Republic and of the PLD, Leonel Fernandez and PRD president Miguel Vargas Maldonado, with the mediation of Monsignor Agripino Nunez Collado, is an attempt by the parties to resolve the impasse that has delayed the passing and implementation of the fundamental laws for the National Council of Magistrates (CNM), the Constitutional Court (TC), and the Higher Electoral Court. The two latter institutions were created in the 2010 Constitution. The agreement was signed at the auditorium of the PUCMM university.
According to the agreement, the politicians recognize that when a fundamental law is completely observed (vetoed) by the Executive Branch, it will have to be heard again and approved by two-thirds of both legislative chambers. If it does not reach the special majority, this legislative initiative will be considered to have been rejected. At the same time, if the observations are partial, they should be approved by the two-thirds majority and if this special majority is not achieved in both chambers and a simple majority is achieved, the observations will be considered to have been accepted and passed.
The president of the Chamber of Deputies Abel Martinez had irregularily passed the bill with observations by President Leonel Fernandez despite the motion not receiving the two-thirds majority. The irregular passing met with major local opposition on grounds that it violated a constitutional rule.
The politicians also recognize that judges of the Supreme Court of Justice need to be under 75 years at the time of their selection to the Supreme Court of Justice. The agreement does not establish an age cap of 75 years, such as in place for the Supreme Court of Justice.
As a result of this pact, the Chamber of Deputies again published the text of the Organic Law on the National Council of Magistrates as reported in today's newspapers and President Fernandez has said that he will convene the council and begin the appointment of the members of the Higher Electoral Court, the Supreme Court of Justice and the Constitutional Court.
President Leonel Fernandez said he would send to Congress for approval new fundamental laws for the Armed Forces, National Police, Intelligence System, changes to the anti-narcotics law, among others.
