President Leonel Fernandez has sent new observations to the Senate aimed at revoking sections of the new Technical Judicial Police law, converted into law under the Fundamental Law of the Attorney General 133-11 this week. The President said he recognizes that the bill violated the Constitution when it placed the Technical Judicial Police under the Attorney General and revokes the measure. The President hopes that this decision will mean that the Police and the prosecutors will be able to comply "in perfect order" and "harmony" with the missions assigned to them in the Constitution, which are to pursue and investigate penal infractions.
The Fundamental Law of the Attorney General 133-11 created the investigative corps of the Police (PTJ) for police investigations. The President says that the law as written violated Arts. 255, 256 and 257 of the Constitution, which establish the competence of the Police to pursue and investigate criminal offences, under the legal direction of the competent authority. Arts. 256 and 257 establish separate jurisdiction for the Police to hear cases related to police offenses.
Fernandez says that the Law 133-11 as passed was in violation of Art. 128 of the Constitution that establishes that the President is the commander in chief of the Armed Forces, the National Police and the other security agencies of the state.
