A Labor Court has ordered a family to pay RD$10,000 in compensation to each of their four household employees for not registering them in the social security health regime. The court ordered the family that employed four men to pay the vacation time, Christmas wage in addition to the compensation for failing to register them in the health program.

The men, who worked planting trees and cleaning a nursery, were seeking one million pesos in compensation.

The judgment by Judge Sergio Antonio Ortega, president of the Second Hall of the Labor Court of the Province of Santo Domingo came after workers German Lora Heredia, Rafael Refeida Heredia, Santos Refeida Heredia and Tomas Heredia sued Jose Hernandez and Marcia Alvarado on the grounds that they were fired for no reason. The court ordered the former employers to pay 14 days of vacation, the Christmas salary and to indemnify the workers with RD$10,000 each for not registering them for the social security services. The workers made RD$8,000 a month. The decision was reached on 30 December 2010, as published in Hoy.

The social security service penalty is a new requirement that had not been specified in the Labor Code in the chapter for domestic help and will now become regularly requested of employers in the future.
