The Dominican Penal Code contains Clause 234 that has enabled Elena Tonton Simon, of Haitian origin, to stay out of jail despite having been arrested on several occasions for trafficking in drugs.

7dias.com.do says that the Permanent Jurisdiction of the National District set her free on bail.

This is the 17th time she has been arrested.

As reported, she was released on the grounds that she is breastfeeding. She has a six-month old baby.

She was arrested on 22 August in Ensanche Quisqueya and 48 portions of crack and 23 portions of marijuana were found in her brassiere. Bail was set for RD$500,000, or a RD$50,000 payment would need to be made.

7dias.com.do reports that Tonton is on record as the woman with most cases of drug arrests in the country. Judge Jose Alejandro Vargas, who released her this time, has set her free on bail on four occasions for the same reason: either being pregnant or breastfeeding.
