One of the nation's most prominent civil society groups, the Foundation for Institutionalism and Justice (Finjus) has once again come out and expressed concern that the National Judicial (CNM) is not being sufficiently transparent in the selection process of the judges who will be sitting on the Supreme Court, the Constitutional Court and the Supreme Electoral Court. Finjus executive vice-president Servio Tulio Castanos Guzman said that one of the fundamental challenges for the CNM is, without a doubt, the "creation of operating mechanisms that provide the public with information on the selection process." He said that this would guarantee legitimacy and transparency. He went on to tell El Caribe that "the adoption of regulations 2011-01 and 2011-02 by the CNM has led to some levels of questioning... by social organizations, jurists and academics because they grant a high degree of discretion to the Council to take decisions without observing the principle of publicity, and leaves behind regular aspects that are essential and covered in the Fundamental Law of the CNM and other laws directly related to citizen rights to be informed and participate in the process." Castanos Guzman expressed his concern that so far the Council has not made available the curriculums of the candidates.
