Puerto Rican drug capo Jose David Figueroa Agosto's lover, Sobeida Feliz Morel, was sentenced yesterday to five years in prison and a fine equivalent to 50 minimum public sector salaries (About RD$175,000). At the same time, her former husband, Eddy Brito Martinez, was sentenced to 12 years in prison. Mary Elvira Pelaez Frappier, Sammy Dauhajre, Juan Jose Fernandez Ibarra and Ivanovich Smester each received 15-year sentences. Madeline Bernard Pena, widow of murdered Lt. Colonel Jose Amado Gonzalez Gonzalez, said to be a close associate of Figueroa Agosto, was sentenced to five years in jail, but the sentence was conditionally suspended. Adolfina Revecca Pelaez Frappier (Dolphy) was found not guilty of the accusation of money laundering and other serious crimes for lack of evidence.
The First Collegiate Tribunal of the Penal Chamber of the Court of the First Instance of the National District accepted the Prosecutor's request and handed down a five-year sentence to Sobeida, who had made a plea bargain with the Justice Department. She received a reduced sentence in exchange for her collaboration that included naming the other people convicted as presumed partners of her former lover, also known as "Junior Capsula". She was found guilty of the crime of laundering assets that came from drug trafficking and other serious crimes.
Judges Gisselle Mendez, the chief judge of the tribunal, July Tamariz Nunez and Tania Yunes also kept the same charges against Brito Martinez, Mary Pelaez Frappier, Dauhajre and Fernandez Ibarra and Smester. Madeline Bernard attended the hearings confined to a wheelchair, as the result of bullet wounds sustained when her husband Gonzalez Gonzalez was killed. The court found her guilty of laundering assets from the illegal trafficking of drugs and other serious crimes as proven by the prosecutors, and for which she was sentenced to serve a five- year prison term and the payment of 50 minimum wages. Nonetheless, the tribunal ordered the total suspension of the sentence, but Bernard Pena is obliged to comply with the rules established by the tribunal during the period legally set by article 41 of the Penal Process Code.
These requisites are: to reside in her apartment in the Serralles sector of the National District, and in case of a change of domicile, to notify the Judge for the Execution of the Sentence in advance. She must also abstain from travelling overseas, and she must learn a profession or trade or study to train herself under the supervision of the competent Judge for the Execution of the Sentence. The tribunal warned Bernard that if she does not obey the rules that were imposed during the established period, she would have to serve the entire sentence in custody. Besides the dismissal of Dolphy Pelaez, the tribunal ordered the return of two of her properties that were seized during the trial process, an apartment in Naco and a house in La Castellana. "This collegiate sentence, reached by a majority vote, has decreed the acquittal of this citizen since the charges formulated against her have not been proven."
However, in her dissenting vote, the Judge July Tamariz said that the defendant had moved about in an environment that was closely related to Figueroa Agosto, without a doubt, since she undertook actions even after the true identity of the capo became known, besides which she acquired an apartment in the Ocean One Condominium, together with Mary Pelaez, and therefore she felt that a 10-year sentence was reasonable.
