The First Criminal Courtroom of the Appeals Court of the National District has postponed until 21 November at 11am its decision on an appeal made by a neighborhood association in Los Cacicazgos against the acquittal of two people who were on trial as a result of a conflict that arose from the construction of the Torre de Plata, located in the upscale Santo Domingo sector.

The Los Cacicazgos neighborhood group is asking the court to completely demolish the nine floors constructed so far because the construction was carried out without the legal permits and in violation of neighborhood rulings. The decision was taken by judges Katia Miguelina Jimenez, Francisco Ortega Polanco and Antonio Sanchez Mejia, after listening to the concluding arguments from the Justice Department, the civilian actors and the defense lawyers.

Justice Department representatives Jessica Ramirez and Elvis Suarez asked the court to accept the appeal and revoke the decision to dismiss which favored Jose Francisco Monet Bambins, for the illegal construction and violations of property lines. The civilian plaintiffs, Miriam Paulino and Jesus Colon requested the court to revoke resolution No. 12/2010, dictated by the Justice of the Peace for Municipal Affairs of the National District with its headquarters in Manganagua. The plaintiffs also asked the court to declare Ramon Mendez Ciccone guilty, as the president of Construcciones Civiles and Arquitectonicas, and Jose Francisco Bonet Gambins. They also filed for compensation of RD$200 million for damages and suffering.

The case is deemed a landmark case for neighborhood groups. If the building is demolished, this would set a precedent for other neighborhood groups to act against property space violations.
