The Higher Administrative Court has rejected a decree of a precautionary injunction by the Dominican Medical Association (CMD) and the Dominican Association of Clinics and Private Hospitals (Andeclip) which would have suspended the implementation of the Primary Care Centers on 1 May 2012. In their sentence dated 6 December, the tribunal ruled that the request filed by the CMD and Andeclip was inadmissible, poorly based and lacking any legal basis. They pointed out that Resolutions 279-02 and 279-03 issued by the National Social Security Council (CNSS) did not constitute a violation of any right or impose any irreparable harm on the plaintiffs.

Faced with the decision, the outgoing president of the CMD, Senen Caba, said that he "is not surprised," since "Dominican justice has demonstrated that it responds to the interests of big capital." Nonetheless, he said that this setback has motivated the CMD to continue the struggle against what he says will cause a decline in specialist medical services.

"This decision taken by the Administrative Tribunal is important for the Dominican Social Security System, because it confirms that the CNSS issues its resolutions in compliance with the law and to the benefit of the population that is affiliated to the SSS and to the System," said Rafael Perez Modesto, the general manager of the CNSS.
