Ministry of Labor inspections have found that 54% of a total of 400 establishments visited do not comply with article 228 of the Labor Code, which establishes that customers should be charged a 10% legal tip to be distributed to workers in bars, hotels and restaurants.

"Only 46% of the companies we visited complies satisfactorily", according to director general of Labor, Andres Valentin Herrera, who said that infractions had been issued against establishments that do not comply with the law.

He also warned that if the situation persists despite the infractions, the businesses in question would be subject to fines ranging from one to six minimum salaries.

Valentin Herrera presented a report on inspection visits made since October at a meeting with trade union representatives.

The report states that of 400 establishments employing some 4,100 employees, only 239 were distributing the 10% legal tip to their workers. Seventy infractions have been issued, which are to be interpreted as a warning before the next step, which is to impose fines.

The 10% legal tip on consumption in bars and restaurants, including fast food establishments, is intended to compensate for the low wages earned by employees in the sector, including hotels.
