Judges of the First Penal Chamber of the Appeals Court of Santo Domingo, headed by judge Kathya Miguelina Jimenez have revoked a judgment that had been issued by the Court of Peace of Manganagua in the case of the Los Cacicazgos residents association against the promoters of the Torre de Plata, a high-rise apartment block next door to the Dominican Fiesta Hotel. Local residents have objected to the building on the grounds that it violates zoning and construction regulations.
In a judgment dated November 2010, Judge Evelyn Torres of the Manganagua court admitted that the nine-floor construction was illegal, but discharged the promoters and the builders from any responsibility.
The neighborhood association is pressing for the building to be demolished and for the builders to be declared guilty of irregular construction.
The Appeals Court ordered a new hearing at the municipal affairs court in San Carlos, presided by a new judge. The conflict has been in the courts for over four years, as reported in Diario Libre.
