The mother of the late 15-year old Webster Solis announced today that on 23 November, the Supreme Court of Justice (SCJ) revoked the sentence that had discharged pilot Affe Gutierrez Gil and his father Rafael Gutierrez Heredia, who were accused of the murder of her son in 2005, of all penal responsibility. This was one of the court's final decisions before it was reassembled.

The SCJ had remanded the case to the Penal Chamber of the Court of Appeals of the National District so that its president may choose one of its chambers for the new hearing. The decision was made by justices of the second chamber of the SCJ, Hugo Alvarez Valencia, Edgar Hernandez Mejia and Victor Jose Castellanos.

The judges ordered the case to be reopened and heard at one of the three chambers of the Court of Appeals.

The decision follows a request made by lawyer Pantaleon Paniagua for Mariluz Solis, mother of the late Webster Solis and another placed by assistant prosecutor general of the Court of Appeals of Santo Domingo, Jesus Mejia de la Rosa. Solis accused Affe Gutierrez and his father of kidnapping and murdering her son in Villa Maria. His body was found near the V Centenario horseracing track on 11 June 2005. Affe Gutierrez was sentenced to 30 years in jail, and his father to 10 years for the kidnapping and subsequent murder of Webster Solis.

The Penal Chamber of the Court of Appeals discharged Gutierrez Gil and his father Gutierrez Heredia of any links with the murder in a decision in April 2011.
