The Central Electoral Board (JCE) could punish the candidates or political parties that incur in the use of "dirty politics" with the aim of distorting the will of the voters. According to JCE president Roberto Rosario, the use of words that distort the truth or which are invented, or the use of lies or inventing facts is something that is not legally permitted during an election campaign. He warned that his institution will be alert as to how the election process continues developing and that they could institute precautionary measures or warnings, as permitted by the Law, in order to guarantee the constitutional rights of the candidates. This could be on his own initiative or if someone files a complaint.

He pointed out the differences between a negative campaign and dirty politics. He said that when a party or a candidate stresses the defects, deficiencies or errors of the other candidate, this is a negative campaign that is legally permitted. But "resort to improper elements outside the law is to take the process towards a denial of the civic rights that are established in the Constitution, and therefore we cannot confuse one or the other thing and obviously the Board has to protect the process and has to protect the candidates and the parties that could be affected."
