The Superior Electoral Court (TSE) has defended its members' democratic right to differ in their decisions and denied that their decisions respond to flippancies or individual interests. The court added that neither does this tribunal get into an internal division or crisis. Mariano Rodriguez, the president of the TSE, spoke in the name of the judges of the new high court during a press conference called to clear up some issues.
He stressed that of the 15 decisions that the TSE has made, one bylaw, two resolutions and 12 sentences, only one was not adopted unanimously. He referred to the sentence TSE-012 - 2012 in which the court declared null and void and without judicial standing the official list of delegates used in the XXXV Extraordinary Convention of the National Veterans and Civilians Party (PNVC) and as a result their assembly decision was also nullified.
Rodriguez said that he was surprised that they would want to confuse society by trying to give the impression that because of a single decision the TSE is immersed in an internal crisis. He argued that their decisions were based on the Constitution and the laws.
In the meantime, the magistrate John Guillani, who was accused in a newspaper ad of being disqualified from acting as a judge because he took part in meetings with political delegates that promoted the motion to invalidate the PNVC assembly, refused to speak on the issue, alleging that he did not want to become part of the election campaign. Judge Guiliani responded to accusations of bias by saying that he would give explanations after 20 May 2012, election day.
