FORT WORTH — The owner of a North Richland Hills cosmetic center was found not guilty Friday of the sexual assault of a customer during a laser hair removal procedure on her bikini line.
Jimmy E. Adams, 59, had been charged with one count of sexual assault, but several other customers had testified that they had been fondled and sexually assaulted at the North Richland Hills Cosmetic Procedures Center.
A Tarrant County jury of seven women and five men deliberated about nine hours over two days before reaching their decision Friday morning.
Immediately after the verdict was read, Adams was rushed to a local hospital suffering from discomfort in his chest, defense attorney Mark Daniel of Fort Worth said. Adams later confirmed he suffered a heart attack.
Adams had been on trial on a single count of sexual assault alleging vaginal and anal penetration. If he had been convicted, he faced up to 20 years in prison.
Daniel told jurors in his closing arguments Thursday morning that the case had blatant inconsistencies.
"If you believe this had occurred, someone would have screamed. Someone would have stormed out of the room, but no one did," Daniel said. "His wife was 15 to 20 feet away. How could it occur with her so close?"
Daniel also noted that one customer, Susie Jones who testified under that pseudonym, did not tell the first North Richland Hills police officer to interview her that she had been penetrated.
"It was first written up as an assault by contact," Daniel said. "Then she gets to talking to friends and another investigator and then it becomes a sexual assault."
Daniel said the center, which opened in 1999, was a highly respected center that had seen 2,500 to 3,000 customers in that time.
Adams showed no reaction while Daniel made his closing remarks. Adams wife, Linda, who also managed the center, testified this week on his behalf. Adams did not testify. At least 10 friends and family members of Adams sat in the courtroom Thursday morning.
But prosecutors called Adams a predator who lulled customers into trusting him.
"Do you actually believe if this did not happen that these women would testify?" Tarrant County Assistant District Attorney Page Simpson asked jurors. "These women did not want to be confrontational when it happened, but it's taken a tremendous amount of courage to have testified."
Simpson said the testimony of at least four customers showed that what Adams did was not an accident or a mistake.
More than 10 female customers, several who testified in the trial this week, sat in the courtroom Thursday. One cried when prosecutor Lloyd Whelchel told jurors to try and imagine what it was like having to go through what Adams is accused of doing to the women.
The women told police that they were sexually assaulted as Adams performed laser hair removal on their bikini lines.
In some cases, after a cosmetic procedure, Adams offered to do a laser hair removal on a bikini line for free, according to court documents.
Adams also faces at least five civil lawsuits against him related to the sexual assault allegations.
The Fort Worth man has had a brush with the law before.
Tarrant County criminal records show that Adams was indicted on March 30, 1983, on a charge of indecency with a child. He was later sentenced to two years' probation with deferred adjudication, records show.
