View Full Version : Electoral Court rules Miguel Vargas stays

On Friday, 15 June, the Superior Electoral Court (TSE) in the Dominican Republic annulled disciplinary sanctions that had been imposed by the PRD Political Commission. Former President Hipolito Mejia's faction had announced party president Miguel Vargas' expulsion from the party. Vargas was notable for keeping a low profile during the recent presidential campaign that resulted in Mejia losing to Danilo Medina of the ruling PLD by four percentage points. Vargas had aspired to be the party's presidential candidate.

The TSE ruled on Friday that the dispositions of the general bylaws of the PRD that allow for expulsions and suspension of any party member for serious faults are in violation of the Constitution. The higher court said that the bylaws violate Art. 69 of the Constitution, which calls for a fair trial and due process.

It accepted the request made by the Miguel Vargas faction, presented by politicians Anibal Garcia Duverge, Rafael Vasquez (Fiquito) and Julio Marinez, and expelled member Victor Gomez Casanova, and ordered the reinstatement of the members who had been expelled.

Judges Mariano Rodriguez, Mabel Feliz Baez, John Guiliani, Marino Mendoza and Jose Manuel Hernandez Peguero read out the decision.

The TSE said that the judges agreed by consensus that the case should not be further debated in the TSE, as it is not their responsibility to study disciplinary actions of the parties, as reported in Diario Libre.
