View Full Version : Constitutional Court revokes city property tax

The Constitutional Court has ruled that Resolution 112-2000 by the City Government of Santo Domingo (AND) violates the Constitution and should be revoked. It took Dominican justice 11 years to decide, but the court ruled this week (TC-0017-12) that the measure imposed double taxation on property owners. The city government sought to tax property owners with an additional 5.25% on luxury dwellings and empty lots. The Constitutional Court says that Law 18-88 already provides for the taxation.

The Court presided by judge Milton Ray Guevara accepted as valid a protest against the new tax placed by the Dominican Association of Builders and Promoters of Housing (Acoprovi) in July 2001. The case had stagnated in the Supreme Court of Justice, which sent it for study by the new Constitutional Court.
