View Full Version : Judge grants bail to Jochy Gomez

The first courtroom of the Penal Chamber of the Appeals Court of the National District has ordered the release under a bail bond of Jose Angel Gomez Canaan (Jochy), who is accused of having "hacked" some 44 e-mail accounts belonging to businesspeople, politicians, diplomats, artists and commentators. Judges Manuel Hernandez, Antonio Sanchez Mejia and Daniel Julio Nolasco accepted the appeal filed by defense lawyers Carlos Balcacer and Carlos Olivares.

They also amended the sentence for remand to preventive custody to an economic guarantee of RD$5,000,000, travel restrictions and periodic attendance before the Justice Department, which is carrying out the investigation. Prosecutors German Vasquez Sosa and Hector Romero had asked the court to reject the appeal by the defendant and confirm the sentence to remand to preventive custody, due to flight risk and because the charges which led to the original sentence have not been varied. The District Attorney's office said that the investigations could determine that the defendant acted in complicity with groups of hackers with international connections, including contacts in India and Vietnam.

The evidence that was presented also included proof that the defendant had been in contact with a company named Activehacker since 2007, with which he allegedly established a working agreement. Upon investigating the company profile, it was shown that Gomez was on their webpage, which proved the existence of a business relationship.
