President Danilo Medina has created a new set of regulations for the application of the Law on Purchases and Contracts for Goods and Services, Projects and Concessions. Decree 543-12 states that the new regulations will cover the purchases and contracts of different kinds between the state and its suppliers. The decree recognizes the need for National Security, which the armed forces and the police need to protect, and exempts them from most of the transparency issues in the regulations. The possibility of national emergencies is also taken into consideration. The long (37-page) decree also addresses the existence of micro, small and medium businesses as possible suppliers of the state, and states that 20% of government procurement must be done through the Mipymes. Another article in the decree obliges the administration to inform small businesses of its plans for purchases so that they can assess whether there is an opportunity to do business with the state.
