[DR1] Judge "strikes" press law

The interim judge at the National District's Second Penal Chamber of the Court of First Instance, Eduardo Cespedes Reyes, struck Law 6132, which governs freedom of the press and libel issues, from the books by reason of his sentence as applied by the new Penal Code. The magistrate cited article 448 of the new Penal Code as the basis for his opinion that "all of the dispositions specifically regarding processes under Law 6132, are abolished, and, as a result, are not applicable." The judge emitted his decision "judgment of the verdict of the incidents" under the number 156-2006. The case concerns a suit against Listin Diario newspaper, its editor Miguel Franjul and businessman Roberto Prats over an alleged defamation contained in a paid advertisement that appeared in December 2005. Speaking through his attorney, the plaintiff, Carlos Gutierrez Marcet, said that they would appeal against the ruling.
