Executive Branch Legal Consultant, Cesar Pina Toribio, believes that the extradition treaty between the US and the DR should be revised to clearly establish the penalty limit that can be imposed on Dominican inmates in the US. He points out, however, that if the proposed modification to the Criminal Code is passed in Congress, that would not be necessary as the new code includes life imprisonment as a possible penalty. The United States justice system does not impose the death penalty on Dominicans extradited to the US for humanitarian reasons only, as the treaty signed in 1909 and still standing, does not limit penalties that can be imposed. Diario Libre indicates that Article 8 of the Dominican constitution establishes the inviolability of life, and this is always quoted in decrees authorizing the extradition of individuals accused of committing crimes and felonies on US territory. The law of extradition indicates that the maximum penalty to be imposed on extradited Dominicans cannot be greater than the maximum penalty in the Dominican Republic - 30 years imprisonment - a modification was later introduced by Congress on 29 July 1998 that now allows life imprisonment.


During the last eight years, the DR has extradited 129 people to the US for federal felonies related to drug trafficking and murder. Last year, 118 Dominicans were extradited, the largest number in one year since 1998.
